General Motors class action alleges Chevy Malibu brake defect - Top Class Actions

General Motors designed, manufactured and distributed model year 2013-2022 Chevrolet Malibu vehicles containing a defective engine part that can cause a loss of braking capability, a new class action lawsuit alleges. 

Plaintiff Tiffany Johnson claims 2013-2022 Chevrolet Malibu vehicles built with 1.5L, 1.8L, 2.0L and 2.5L engines contain defective cam-driven brake vacuum pumps, which, in addition to causing a loss of the ability to brake, increase stopping distances and damage the vehicle’s “camshaft and other engine components.” 

Johnson argues the alleged defect presents an “unreasonable risk to occupants’ safety and predisposes occupants to injury, accident and death.”

“Designing and manufacturing vehicles with safe and reliable braking systems is paramount to ensure the safety and wellbeing of drivers, passengers and others on the road,” the General Motors class action states. 

The National Highway Traffic Safety Administration is aware of the alleged Chevy Malibu brake defect due to driver complaints detailing collisions which have occurred due to their brakes failing, according to the General Motors class action. 

Despite this, Johnson claims General Motors “has taken no action to correct the root cause of the Brake Defect.” 

When General Motors does seek to repair the issue, Johnson argues that it simply “removes and replaces defective parts with new, but equally defective, parts.” 

Johnson claims General Motors is guilty of fraudulent concealment/omission and breach of express warranty, among other things, and in violation of the Magnuson-Moss Warranty Act and Virginia’s Consumer Protection Act. 

She demands a jury trial and requests injunctive relief along with punitive damages with herself and all class members.

Johnson wants to represent a nationwide class and Virginia subclass of all persons or entities who have purchased or leased a 2013-2022 Chevrolet Malibu containing an allegedly defective cam-driven brake vacuum pump. 

General Motors also recalled around 680,000 of its 2014-2015 Chevrolet Equinox and GMC Terrain vehicles earlier this year over concerns they contained defective windshield wipers.

I have a 2020 malibu i have to voluntary surrender because it does not even brskr anymore. I cannot push the brake down as it seized up on me and I almost went into a lake but I had to ebrake real fast. Of course the bank and chevy won’t admit it as they claim theyvwill inquire about chevy stating its a lemon. I had issues over a year where the brake would lose pressure and fall to the floor and maybe about 5 minutes later the brake pressure would come back. Was so worried when I drove it because I knew it was a hazard on the road. The bank did not care or even let me get a deferment to use those funds to fix the car as they wanted their money first. There is no fix they inly replace with defective parts and it tears up other critical engine and transmission parts. I also woukd hear fluid moving behind the engine which they said was normal, which I’ve never heard before. The dealerships were on strike for months where I am so I couldn’t get it properly inspected or fixed for months. I took it to a Annie Bauer and they couldn’t find anything Eleven with check engine light on and yet they turned my check engine light off. It also created issues in the vacuum intake and more. I coukd not get 4 or more reports to consider for a lemon case because of them on strike and being shorter hours due to pandemic and now I am displaced because the car won’t brake and its been down for about 2 months now. Bank does not care and I have to take the process but these cars are nice but the issues happened around 30k miles and went on for a year and it woukd also randomly shut off as I put it in reverse. They stated in the case the issues stemmed from the 2016 versions so that means they j ew these cars had issues when they created the deal. That is unfair and unjust. Now I have to deal with evil lender and technically a loan that was originated from deception. As well as funny paperwork. This isnt fair as many cars these days aren’t worth the price and they have serious issues that wont even last only until the new car warranty expired.

Recently got more help form a higher up from the bank about a extended warranty i should have to see about fixing the car with the warranty and to contact the manufacturer and a few steps to take which was more helpful than previouscustomer service experiences but now I will see if the manufacturer will provide any type of assistance to the situation if not I will have to make other arrangements. I appreciate the man trying to help get me more information but hopefully there’s some type of real fix for this as i see even the newest models have issues as well and I just read earlier that they will be discontinuing the malibus after the 2023 are done

when u do a voluntary surrender, is that bad? does it hit credit hard?

I have a 2016 Chevy Malibu and I have an issue while driving on the expressway where I’m at an accelerated speed and then the car will decelerate to below 20 mph, but It won’t allow me to push on the gas. This has happened when I’m in the left lane with trucks behind me while my kids are in the car. I’ve almost gotten into horrible accidents trying to get over to the side of the shoulder, and at times the car has completely shut off and lost power not allowing me to even open my windows or locks. It is a major hazard and can cause life threatening injuries if I am in an accident because of this. My car hasn’t even hit 90,000 miles, and I’ve had this issue repaired more than 3x by the dealer before the 36,000 mile warranty. GM headquarters has been made aware as I have called to make a case with them and they’ve done nothing to remedy the situation. I am still with this car and still have the same issues which have now grown and become more intense. Please add me to any class action taken with GM, as I am still paying on my vehicle loan and stuff with this Lemon.

try your check your cam shaft sensors but i doubt we get anywhere i have same car and it broke down in the driveway bc of the BRAKE VACUUM PUMP! WAS not happy when it decided to go, not a fun experience … hubby owes over 11 k on it still,

i have a 17 malibu lt, only 57k miles on it. brakes went out while i was driving to work one morning. as of now the part (vaccum pump) is on back order and i dont know when my car will be fixed. and i only had the car for 3 months.

I have a 2018 Malibu LT. Not issues with that so far but doesn’t make me happy to hear this and worry for mine and others safety. I have had issues with it not shifting Into park properly and engine won’t stop till in gear properly. Hoping to get resolved at inspection this month. Also have a sound from rear trunk area when I brake or step on gas sounds like something rolled in trunk area and makes a thud sound. Heard that is a common issue with Malibu

I have a 17 Malibu. I’ve replaced the brake booster 3x in 4 years, the car has 86k on it. Every time I get it fixed, they have to use a magnet to remove the pieces that have broken off into my motor.

Also have huge problems with “engine power reduced”.

I just had this happen last night. I have a 2016 Chevy Malibu. Went to change the vacuum pump and it shattered into little pieces. I’m at a loss. I still owe on the car. But it’s going to cost to get it fixed.

I was driving on the interstate headed to work this morning and I met resistance when pushing on my brakes to slow down. One of the scariest moments of my life!!! Thankfully I was able to exit off the highway safely and go to a gas station and stop the car without incident. Repair ship called and told me the hose to the vacuum pump came lose, and my cam shaft broke off. Best case scenario was that’s the only thing wrong . Worst case a piece from the cam shaft broke off and went into the engine

I have a 2017 Malibu and my vacuum pump shattered and the brakes went out on the highway. I have had loss of engine power and stabilitrak issues still after replacing. I feel there are also still pieces of the vac pump that broke off in the engine. All this happened at about 90K miles.

This has happened to me with my 2016 malibu with NO warning driving down the highway. I have 120k miles in my car and it’s been kept up with all maintenance. My husband contacted The dealership who told him this is a common problem for the vacuum pump to fail. Now I have cam and crank codes . God only knows what this has done to my car..

This also happened to me with the 2018 equinox same issue … It screwed up almost crashed and the car doesnt even start now… Is there a law suit for 2018 chevy equinox i think its the same part and break system and same break down

I recently purchased a used (1 owner; 93k mi) 2014 Malibu. No problems so far. Vehicle history showed timely routine maintenance was performed; no mention of brake system defect.

I have a 2018 Malibu and replaced the vacuum pump last year after it went out while I was driving in traffic and I had no brakes. I almost ran into the back of someone’s car. Now this year I have it in the shop again and the dealership is saying the vacuum pump is out again and this time I also need a new engine plus a new turbo. They’re telling a estimate of around 10 to 12 thousand to fix it. It’s not even been a year since I replaced the vacuum pump last year. Oh and this time it lost complete power while I was driving it and luckily I was able to coast it off the road. The dealership wants over 4 hundred dollars just for me to pick the car up after they told me what’s wrong with it and they literally didn’t do anything really so it’s still there right now.

Had to have my break system replaced twice now on my 2017 Malibu and had to get a bridge stone credit card to help me cover the cost.

Been having the same problem with my 2015 LT for over a year. Purchased it used less than two years ago and 6 months into owning it started having problems with the brake booster and it sometimes sets off my check engine light and “service brake assist” code. it’s been over a year and I’ve been to 4 different shops over a dozen times and no one can figure out how to fix it. Just brought it in to where I bought the car (I bought used from a Honda dealership and figured they wouldn’t know that to do with it as it ls a complex problem and they only specialize in Hondas) as Ive had enough and they had to ship it to the chevorlet dealership and give me a loaner car to have them look at it as they can’t diagnose the problem.

I just went through this – 2016 Malibu – been under repair for 2 weeks. Luckily my mechanic took extra time to try to get all of the shattered pcs out to try to prevent further damage to my vehicle. Very scary – NO brakes at all….no brake pedal compression. Please add me to your list.

yess!! i’m going through this right now. my brakes randomly went out when i was driving with my 2 year old and now my car is inoperable. the dealer diagnosed a faulty vacuum pump that had sent pieces of metal into the camshaft. i need a bunch of new stuff and i’m praying my extended warranty covers it. i’ve only had my car for 6 months it’s a 2020. :(

I bought a 2018 2.0T and the back brake light on top cracked in half already. My shifter didn’t go into park. I have had no break issues yet.

Yes my 2013 Malibu did the same thing then they told me it was fixed back it out of the dealer shift after them telling me it was fixed about hit a telephone pole because it would not stop
